Before adopting, learn about Oklahoma's consent laws

For many Oklahoma residents, adopting a child is a dream come true. It is a uniquely rewarding experience for most of the involved parties. The adoptive parents get to love and nurture a child; the child receives a home and unconditional love; and the biological parents get peace of mind with the knowledge that the child will have a special life. Even the family law attorneys involved share in the joy of adoption.

Those who are adopting a child want the experience to proceed as smoothly as possible. One way to achieve this goal is by learning about the laws that govern adoption. Consent laws in particular are important in the adoption process. Of course, the biological parents should learn these laws, but it is beneficial for the adoptive parents to learn them as well. This prevents all parties from being blindsided by potential adoption issues.

Oklahoma is one of several states that offer a degree of leeway about the timing of an adoption consent. Biological fathers can give the consent to adopt anytime before or after the child's birth. Further, there is no required period adoptive parents must wait to execute the adoption once consent has been given.

In all states, it is difficult for one or both biological parents to change their mind after giving consent. In Oklahoma specifically, revocation of consent can only be executed if all involved parties agree to stop the adoption. If fraud or coercion is a factor, it may also be possible to revoke an adoption consent.

Working with a family law attorney throughout the process gives adoptive parents an extra measure of security. It is one of the best ways to ensure the adoption is legal, airtight and in everyone's best interests.
